Learning from the 2021 Survey of State Tax Departments – Corporate Income Taxation

For the 21st consecutive year, Bloomberg Tax has sought to clarify each state's position on nexus and other grey areas in state taxation by sending its annual Survey of State Tax Departments to senior state tax department officials in the District of Columbia, New York City, and the 46 states that impose a corporate income tax. In addition to nexus, the questionnaire asked officials about their state's tax sourcing rules, states’ responses to federal tax changes made by the TCJA and the CARES Act, and requirements for reporting federal changes. Additionally, Bloomberg Tax asked the states about their combined reporting regimes and conformity to the Multistate Tax Compact. 

This webinar will take a closer look at the recent trends in state corporate income taxation, analyze the survey results in these areas, and provide a discussion on recent changes in states’ taxation of corporations.

Amy Nogid

Amy Nogid is counsel in the State & Local Tax Group at Alston & Bird. She represents clients in all stages of state and local tax work from multistate tax planning and restructuring through audit to resolution via settlement or litigation. Amy has litigated seminal SALT cases nationwide, including before the U.S. Supreme Court. Amy also advises industry-leading clients across the country in unclaimed property matters. With more than 35 years of experience, Amy partners with clients, ranging from startups to Fortune 500 companies, to represent them in a broad range of transaction-based taxes, including income, franchise, sales and use, and excise. Before joining private practice, Amy served as an assistant chief in the Tax and Bankruptcy Litigation Division of the New York City Law Department, litigating numerous tax cases on behalf of New York City’s Department of Finance. She also spent several years in public accounting.

Fred Nicely

Fred Nicely is a Senior Tax Counsel at the Council On State Taxation (COST). His role as Senior Tax Counsel extends to all aspects of the COST mission statement which is to preserve and promote equitable and nondiscriminatory state and local taxation of multijurisdictional business entities. Before joining COST, Fred served in the Ohio Department of Taxation for four years as Deputy Tax Commissioner over Legal and for the prior seven years as the Department’s Chief Counsel. Fred’s responsibilities at the Department included testifying before legislative committees, participating as an alternative delegate for Ohio at Streamlined Sales Tax Project meetings, and reviewing legal documents issued by the Department. Fred also has extensive experience in public utility tax law, having served as an administrator of the Department’s public utility tax division. Fred’s undergraduate degree in psychology (with a concentration in accounting) is from the Ohio State University. He obtained his MBA and JD from Capital University in Columbus, Ohio.

Harley Duncan

Harley Duncan is Tax Managing Director, State and Local Tax, at KPMG LLP. His primary responsibilities at KPMG include working to establish and improve business relationships with state taxing authorities, assisting clients in working with state tax agencies, and keeping clients and firm members abreast of current developments. In addition, Harley works with the firm’s State Tax Resource Network to strengthen business relationships with state tax agencies. Prior to joining KPMG in July 2008, Harley spent the previous 20 years as executive director of the Federation of Tax Administrators, the association representing the principal state revenue collection agencies in each of the 50 states, Washington, DC, and New York City. He also served five years as secretary of the Kansas Department of Revenue. Prior to that, Harley was the assistant director of the Kansas Division of the Budget. He has held positions with the South Dakota state government, the Advisory Commission on Intergovernmental Relations, and the National Governors’ Association. Harley received New York University’s Outstanding Achievement in State and Local Taxation Award in December 2006 and was awarded the IRS Commissioner’s Award in June 2008. He was cited as “The Most Influential Person on the Planet in State and Local Tax” by State Tax Notes in 2008.

Lauren E. Colandreo

Lauren Colandreo is a Senior State Tax Analyst with Bloomberg Tax, where she analyzes recent changes in state tax law, develops new products and maintains existing products, including Bloomberg Tax’s practice tools, navigators and portfolios. Lauren also co-authors an annual special report analyzing the results of the Bloomberg Tax Survey of State Tax Departments. Lauren’s primary focus is nexus-creating activities for corporate income tax and sales and use tax, as well as tax administration and property tax issues. She holds a B.S. and a B.A. from Salisbury University, a J.D. from the Columbus School of Law at the Catholic University of America and an LL.M. in Taxation and Estate Planning Certificate from the Georgetown University Law Center.
