Learning from the 2020 Survey of State Tax Departments – Corporate Income Taxation

Description

For the 20th consecutive year, Bloomberg Tax has sought to clarify each state's position on nexus by sending their annual Survey of State Tax Departments to senior state tax department officials in the District of Columbia, New York City, and the 46 states that impose a corporate income tax. In addition to nexus, the questionnaire asked officials about their state's tax sourcing rules, states’ responses to federal tax reform, and requirements for reporting federal changes. Additionally, Bloomberg Tax asked the states about their combined reporting regimes and conformity to the Multistate Tax Compact.

This year, the survey was expanded to include questions addressing add-backs and alternative apportionment.

This webinar will take a closer look at the recent trends in state corporate income taxation, analyze the survey results in these areas, and provide a discussion on recent changes in states’ taxation of corporations.

Lauren E. Colandreo

Lauren Colandreo is a Senior State Tax Analyst with Bloomberg Tax, where she analyzes recent changes in state tax law, develops new products and maintains existing products, including Bloomberg Tax’s practice tools, navigators and portfolios. Lauren also co-authors an annual special report analyzing the results of the Bloomberg Tax Survey of State Tax Departments. Lauren’s primary focus is nexus-creating activities for corporate income tax and sales and use tax, as well as tax administration and property tax issues. She holds a B.S. and a B.A. from Salisbury University, a J.D. from the Columbus School of Law at the Catholic University of America and an LL.M. in Taxation and Estate Planning Certificate from the Georgetown University Law Center.

Joe Huddleston

Joe Huddleston is a managing director at Ernst & Young LLP’s National Tax Department serving the Indirect, State and Local Tax practice. He currently advises both national and multinational firms on planning and controversy issues. Prior to joining EY, Joe served for ten years as Executive Director of the Multistate Tax Commission. Additionally, Joe has also served as Commissioner of the Tennessee Department of Revenue from 1987 to 1995. He served on the State Board of Equalization for six years and presiding officer for three years. During his tenure as Commissioner, he was president of both the Federation of Tax Administrators and the Southeast Association of Tax Administrators. Immediately after leaving the Tennessee Department of Revenue, Joe became chief financial officer for the Metropolitan Government of Nashville and Davidson County. In that position, he was responsible for all of the city's financial affairs, including more than $1.5 billion in annual expenditures.

Marilyn A. Wethekam

Marilyn A. Wethekam is a partner at HMB Legal Counsel in Chicago. She has a national SALT practice representing multistate and multinational corporations in all areas of state tax. Ms. Wethekam advises her clients on multistate tax issues that involve income, franchise and transaction taxes. Her eighteen years of corporate tax experience with Mobil Oil Corporation and Montgomery Ward & Co. provide her with an understanding of the complex issues encountered by multistate and multinational corporations. This understanding allows her to develop innovative solutions for multistate tax issues as well as the practical resolution of multi-jurisdictional tax disputes. She has formulated multistate audit strategies, drafted legislation, and represented multistate and multinational corporations in income, franchise, transactional tax matters in more than thirty-five states. In addition, she has worked with clients to develop organizational structures that incorporate both an understanding of the business needs and address tax burdens.

Steven N.J. Wlodychak

Steve Wlodychak is a retired principal with EY and currently serving as a contractor to the firm on state and local tax policy and transactional matters. Prior to his retirement just a few short weeks ago, Steve was the State and Local Tax Policy leader for EY’s Americas Tax Policy in Washington, DC. He previously worked in the EY Los Angeles and New York offices, was a state and local tax attorney for an international insurance company and an associate attorney with a major regional law firm. He previously worked in state government in New Jersey, including for the governor of the state. A frequent speaker and writer on state and local tax developments, Steve was honored by Bloomberg Tax & Accounting as its Co-Author of the Year for 2017 for his work on its Pass-through Entity Navigator (PTEN). EY also awarded Steve its first ever lifetime achievement award as tax educator of the year. He also is a guest lecturer on state and local tax matters for the LL.M. in taxation program at the Georgetown University School of Law. Steve holds degrees from Georgetown University’s School of Foreign Service, Seton Hall University School of Law and a master’s degree in tax law from New York University School of Law.
